Should appeals appeals against the variation of SPO be heard in the Court of Appeal Criminal Division or the Court of Appeal Civil Division

There has been an interesting judgement in the Appeal Court concerning Appeals against Sexual Prevention Orders – should they be heard in the Criminal Courts or the Civil Courts.
The Appeal also touches on sentencing practice.
